1. Introduction

Welcome to Focus Media ("we," "us," or "our"). We provide professional photography and videography services in California. By booking our services, you ("Client") agree to be bound by these Terms and Conditions.

2. Services

‍

Focus Media offers a range of photography and videography services. The specific scope of work, including deliverables, timelines, and any special requests, will be outlined in a separate service agreement or project proposal. Additional services not specified in the original agreement may incur extra charges.

3. Booking & Payment

‍

• Deposit Requirement: A 50% down payment is required to confirm the booking, and it is non-refundable.
• Full Payment: The remaining balance must be paid before final media delivery.
• Accepted Payment Methods: We accept credit and debit cards via our online invoice payment system. When necessary, we also accept cash or Zelle. We do not accept escrow payments or any alternative payment methods. Due to recent check fraud scams, we do not accept checks anymore.
• Late Payment: If full payment is not received as agreed, final media files will not be delivered.

4.Rescheduling & Cancellations

• Rescheduling: Clients may reschedule a shoot at least 24 hours in advance with no penalty.
• • No-shows will be billed for the half of the amount.

5.Turnaround Time & Revisions

‍

• Delivery Times:

  • Listing photos, floorplans, and Matterport 3D tours will be delivered within 24 hours.
  • Social Media Reels and Lifestyle/Headshot Photos will be delivered within 48–72 hours.

• Revisions:

  • Each project includes up to two rounds of minor revisions at no additional cost.
  • Additional rounds of revisions will be billed at $50 per round.

6. Travel & Additional Fees

‍

• Travel Fees: A travel fee applies for locations beyond 10 miles from our base location. The fee is $1.00 per mile beyond this radius.
• Additional Services: Any additional services, such as extended hours or extra media coverage, may be requested at an additional charge.

7. Media Usage & Licensing

‍

• Client Usage Rights: Upon full payment, clients receive full rights to use the final media for marketing and promotional purposes.
• Focus Media Usage Rights: We retain the right to use any photos or videos for our portfolio, marketing, and promotional purposes unless otherwise agreed in writing.
• Edits & Modifications: Any additional client edits or third-party modifications to the final media must be reviewed and approved by Focus Media to ensure brand consistency.

8. On-Site Expectations

‍

• Property Preparation: Clients are responsible for ensuring that the property is staged and ready for photography or videography upon our arrival.
• Delays: If the shoot is delayed due to the property not being ready, additional time will be billed at our hourly rate of $200 per hour.

9. Limitation of Liability & Indemnification

‍

• Limitation of Liability: While we commit to delivering high-quality work, Focus Media is not responsible for any lost sales or perceived damages resulting from delays in media delivery, rescheduling, or cancellations.
• Indemnification: The client agrees to indemnify and hold harmless Focus Media from any liability, damages, or claims arising from the use of the final media.

10.Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the State of California. Any disputes arising from these Terms will be subject to binding arbitration in accordance with applicable laws, unless otherwise agreed in writing by both parties.

11. Changes to Terms

‍

Focus Media reserves the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website. Continued use of our services after any changes constitutes acceptance of the updated Terms.

12. Agreement & Acknowledgment

By proceeding with our services, the client acknowledges and agrees to all of the terms and conditions outlined above.
